CALVARY CEMETERY


Establishment and ownership of a parish cemetery - is an act of extraordinary administration which requires the bishop to have the consent of the diocesan officials before it can be established. It is to be blessed in accordance with canons 1205 and 1208 of the Code of Canon law.

Once approved and blessed, the cemetery is then owned and operated by the parish corporation. Title is to be in the name of the parish corporation and a deed and abstract of title is to be kept with corporation records.

Administration of the cemetery is exercised by the parish corporation and in conformity with the law, rules, and regulations of the Church of St. Peter, the Diocese of New Ulm, the Roman Catholic Church and the State of Minnesota. All work is to be done only by those authorized by local management.

Cemetery funds are to be established for an operating fund, and a perpetual care fund. Minnesota law prevents the loaning of cemetery funds for parish purposes. Monies are to be held in low-risk investments. The interest earned from perpetual care fund investments is transferred to the operating fund and the principal of the perpetual care fund may not be expended for any purpose.

Local Management has complete power to set the price of lots, issue instruments of conveyance (certificates and deeds). Lot owners are granted only the right of interment in their lots. The local ownership has formulate parish cemetery regulations pertaining to placement of memorials, sale of lots, planting of trees, flowers and decorative shrubbery.

Interment and disinterment - a burial permit as required by Minnesota law must be presented and permission of the lot owner must be received before interment can take place.

Cost of lots - the current price is $500 for graves facing east and $450 for graves facing west. Infant graves will increase from $150 to $200. Involvement of cemetery personnel is needed for spotting a grave and for placement of a memorial stone.
